Terms of Service & Privacy Policy

• You must be at least 18 years old to use Learnwell.
• By using the Service, you represent and warrant that you meet this requirement and have the authority to enter into this Agreement.

• You must create an account to access most features.
• You agree to provide accurate and complete information and to keep it up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws.
• Reverse-engineer, scrape, or attempt to bypass security or access restrictions.
• Upload or share content that is abusive, harmful, defamatory, or otherwise objectionable.
• Misrepresent your identity or affiliation.

We may suspend or terminate your account for violations of these Terms.

• You may create, store, and manage personal notes, AI conversations, searches, preferences, and other data (“User Content”) within the Service.
• Your notes are private to your account unless explicitly shared by you.
• You grant us a non-exclusive, worldwide, royalty-free license to store, process, and use User Content for:
  1. Providing and improving the Service;
  2. Training and refining AI models (in anonymized or aggregated form);
  3. Detecting and preventing abuse or technical issues.

• The Service may provide AI-generated text, images, or other materials (“AI Output”).
• AI Output may be inaccurate, incomplete, or outdated and is provided for informational purposes only.
• You agree not to rely solely on AI Output for decisions requiring professional advice (legal, medical, financial, etc.).
• Even if reviewed by humans or experts, we cannot guarantee its factual accuracy.

• Learnwell offers free and paid tiers.
• Paid subscriptions are billed via App Stores (Apple App Store, Google Play) for mobile users and Stripe for web users.
• All paid upgrades include a 7-day free trial. After the trial, charges are non-refundable.
• Prices may change with reasonable notice.

This Service may be used by:

1. Consumers for personal learning.
2. Companies & Teams for internal training and development.
3. Influencers / Thought Leaders to create, promote, and sell their own courses (“Creator Content”).

Additional terms for these cases:

• Company Accounts: The individual creating the account for a company represents that they have authority to bind the organization.
• Creator Content: You are solely responsible for the legality and quality of the content you publish or sell. You grant us the right to host, distribute, and market such content within the Service.
• We may offer separate enterprise or creator agreements for custom terms.

• All Learnwell branding, design, and software are our property and protected by intellectual property laws.
• You may not copy, modify, distribute, or create derivative works from our materials except as expressly permitted.

We care about your privacy.

Data We Collect:

• Account info: name, email, password (hashed via Supabase authentication).
• Usage data: searches, notes, AI chat discussions, preferences.
• Payment details via secure third-party processors (Stripe, App Stores).
• Analytics data (via secure analytics services, e.g., Google Analytics).

How We Use It:

• Operate, maintain, and improve the Service.
• Personalize your experience and recommendations.
• Develop new features and offerings.
• Train and refine AI models (with anonymized/aggregated data).
• Comply with legal obligations.

Data Storage & Security:

• We store data using secure third-party hosting providers (e.g., Supabase, Expo Application Services).
• While we implement industry-standard security, no system is 100% secure.

Data Sharing:

• With trusted service providers to help us operate the Service.
• In aggregated or anonymized form with partners.
• As required by law.

Data Retention & Deletion:

• We keep data as long as your account is active or as needed for legitimate business purposes.
• You may request account and data deletion by contacting support@learnwellapp.com.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

To the maximum extent permitted by law:

• Learnwell is not liable for indirect, incidental, or consequential damages.
• Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim arose.

This Agreement is governed by the laws of British Columbia, Canada, without regard to conflict of laws principles.
